If a couple got married on the spur of the moment while one of them was in the US and they apply for AOS, I've heard that they might be asked to prove that there was no plan to marry beforehand; but what sort of proof could they give of this? Has anyone done this?

10/10/06 - We meet in an online forum.

4/23/07 - We are officially a couple. <3

7/17/07 - First meeting in person - Rochester NY (several visits back and forth follow).

12/15/08 - Our daughter, Annika, is born.

4/1/09 - Christian comes to visit on the VWP (5th visit to US, POE is Newark, no hassles).

5/26/09 - We get married! Small wedding, planned in a month, but very nice. :)

Adjustment of Status

7/3/09 -- Mailed I-485,I-130,I-765,I-131, Medical - certified mail

7/6/09 -- Delivery confirmation on USPS website

7/14/09 -- Receipts arrive.

7/16/09 -- Can pull up case with receipt numbers on USCIS website.

7/25/09 -- RFE. Our joint sponsor did not provide proof of citizenship or enough proof of his income.

8/17/09 -- Received AP document.

8/19/09 -- Biometrics appointment.

8/28/09 -- Received EAD card.

9/29/09 -- Interview - APPROVED!!!

10/3/09 -- Welcome letter.

10/9/09 -- Green card in hand!

I did this. We had no intention to marry. We went on a cruise in November and I ended up staying through the holidays and decided that we didn't want me to go back to Canada. So we got married in January which was about 60 days after I entered on VWP (B-2). Everything is going smooth so far, no approval yet but it shouldn't be an issue. We consulted 2 lawyers.

Yes I did AOS from a VWP... the proof I had was my house in the UK, letter to my employer telling them I would not be returning, My car was sitting in the long term parking at Glasgow airport and I had to mail the Keys to my Father so he could go and get it. I took all this evidence with me to the interview but I was not asked anything about my intention to remain on entry....

the only proof we had was a return ticket to glasgow for my husband. BUT, our interviewing officer never even mentioned vwp, or if we had any intentions. you should be ok.

07/12/07: RFE for proof of joint sponsor's citizenship (Day 21)

07/21/07: Biometrics Appointment in Atlanta (Day 31)

07/23/07: Returned RFE with wanted documents arrives in Missouri (Day 33)

07/25/07: I-485 *touched* (Day 35)

09/06/07: EAD Card Production Ordered (Day 77)

09/12/07: EAD Card recieved in the mail!!! (Day 83)

09/18/07: Interview in Atlanta!!!!!!!!! (Day 89) APPROVED PENDING NAMECHECK!!!!

11/09/07: Card production ordered!!!

11/20/07: Greencard received!!!!!!!!

08/15/09: I-751 package mailed!

08/17/09: Package delivered to VSC.

08/18/09: NOA 1 Extension Letter!! (received 08/24/09)

08/20/09: Check cashed!!

09/29/09: Biometrics in ATL!

Intention is RARELY questioned unless you got married 2 weeks after you entered the US under the VWP or a B2.
