Hi. This is my first post and i'm really hoping i can get some help.I am a Uk citizen. On November 2005 i went over to see my girlfriend who is a USA citizen. My intention was not to marry her when i went over but it ended up we did. We married in 6th January 2006 and did adjust of status , think it was the 1-129f form if i am not mistaken. Anyway i had to leave on 22nd March as my mother was dying back in the UK. Things didnt work out with my wife so i didnt attempt to return back. I know it seems odd what i did but i did love the woman but we all make mistakes and learn by them. I overstayed by 24 days.

As my fiance will be applying for the K1 visa after i am divorced, hopefully around January 2008. Will it raise a flag as i was married to a US citizen before? Were still trying to decide whether to get an immigration lawyer involved but arnt sure who is good and who is bad. We want to go down the correct route as we have heard a few people having problems appyling the K1 themselves. Can anyone recommend what good lawyer to use? My fiance lives in South Carolina.

You will be asked about it, but you shouldn't have any problem with. Only overstays of 180 days or more will get a ban.

Once you are divorced from her, it should be no issue. They will ask about it at the interview and on the filing forms. But as long as proper documentation is provided, there should be no problem. It is not always necessary to engage a lawyer to file.
