We just received our packet 3 from Montreal and have a question???

Can anyone speak to IRS issues and filing in Canada. She has been living in Canada as a landed immigrant for 26 years and not filed tax returns in the US. We thought that was correct since she was not domiciled in the US. Was she supposed to be filing and will she need to file in order to fill out the affidavit of support form.

Timeline: For IR-1 - DCF

Aug. 28/07 I-130 delivered and approved at Calgary Consulate

Sept. 7/07 I-130 Forwarded to Montreal from Calgary

Oct. 10/07 Packet 3 Received in the mail (reglular snail mail)

Oct. 11/07 DS-230 Returned to Montreal (regular snail mail)

Oct. 15/07 Checklist Returned to Montreal (regular snail mail)

Feb. 11/08 Received email with interview date set for March 12/08

Feb. 20/08 Medical in Vancouver

Feb. 21/08 Received interview letter in mail with correct address on it - finally

Mar. 12/08 Interview in Montreal, Visa approved

Mar. 17/08 Visa arrives in mail

Mar. 29/08 Crossed the border at Sweetgrass, Montana: Set up residence at Williston, ND

April. 18/08 Green Card arrived in the mail

April 21/08 Social Security arrives in the mail

The simple answer is yes. Even when not domiciled in the U.S. citizens are required to file.

Did she earn any money? I assuming so. If that is the case yes she will have to do her returns.

The thing is technically she should have filed for the last 26 years, unless she was not required to do so because her income was too low to file. That cut off amount is included in the instructions for each year. (It's around the $3000 U.S. mark for 04/05/06).

Basically right now, if she had income over that she will need to file for 04/05 and 06 to complete the affidavit of support.

i am new at this and may be jumping the gun so please forgive.. but what is in the packet 3 and 4.. i want to let him know exactly what he needs for the interview and what forms are in these packets :help::wacko:

Quick fix: File the last years and investigate what she will need to do to 'come clear' ;) with the IRS. My husband didn't know about filing either, and we filed 'late' - so far, no problem (4 years of non-filing). She will need to file at least the 3 years immigration officials require, me thinkssss.
