I recently visited my my fiancee for the first time and we think she may be pregnant. I just sent our I-129F petition to the USCIS. If she is pregnant will that have any affect whether positive or negative, on the process. We intend to notify the USCIS as soon as we find out from an OB-GYN later this month. If she is pregnant then we will have the doctor make a certified letter stating that she is pregnant and how many weeks along she is in her pregnancy and she will mail that to the service center here. Thanks for any advice you may have.

The USCIS will not be concerned about the pregnancy so notification is not needed. The consulate may ask a few questions and the medical will be different dependant on what stage she is at when that occurs

Makes no difference on the process, the consulate may delay the interview if it comes up close to time of birth, so that travel may be avoided during late pregnancy.

You do not need to send anything to the USCIS service center.

Although it is possible, you cannot be confident of your fiancee arriving in the US before the child is born.

No need for notification to USCIS. You don't mention whether you are the father. Assuming you are, and the baby is born before the visa is issued, you'll need to engage in the process of getting the baby a US passport and citizenship.

If you will be the step-father and the visa is issued after the baby is born, it can be issued a K2 visa. You cannot list an unborn child on the I-129F, so the Consulate would need to be notified. You may also need a full custody document or permission from the natural father.

In either case, the child will also need a passport for international travel and/or affixing of a visa.

Facts are cheap...knowing how to use them is precious...

I have a friend at work who applied for his wife's spousal Visa, she got pregnant somewhere along the line, and her medical exam had to be delayed until her baby was born. I'm not sure if the K1 is different, but it's worth checking into.

Thank's every1 for your advice. It is so greatly appreciated. We are not sure yet if she is pregnant, but if she is, yes I am definately the father. Thanks again for everyone's advice, it is a tremendous help to myself and my fiancee.
