Hi my name is Russell,

i am in desperate need for some information. I met my GF in Hawaii whilst travelling 6 months ago, i left to go home after a month then flew back to see her in Ohio (where her family is from, she was schooled in hawaii) i stayed with her for two weeks and decided this was the girl for me. So we planned on her to come and live with me in England, so she did and has been living with me in England for the past month. She has found many jobs but the work permit application process in the UK is ridiculous! She dosent have a college degree as she dropped out after one year, it makes things hard. Im a part qualified accountant working for the NHS and have decidded that i want to spend the rest of my life with this girl. Not just because that way she can stay, because i love her unconditionally. We have spoken alot recently about the future, as she is getting more and more frustrated being sat at my flat whilst i work. She is thinking of going back to Ohio to work again. Im going to propose. However i need to know some things before i do. I dont want to be one of those people that propse and never get married, she feels the same. So can we apply for a Fiance Visa K1, for the US from the UK? can we send the relevant forms from here? or does she need to be in the US? does she need to be working in the US? and finally, if all of this isnt possible, what if we pay a attorney? can we get away with her not going back to the US till her visa is up? (FEB).

I would appreciate any input.

Yes, you can send in the forms from the UK. She does not need to be in the US for this process to be a success. As long as you have a straight forward situaltion, there should be no need for an attorney.

can we get away with her not going back to the US till her visa is up?

Yes.

I forgot to add if your fiance does not have income, she will need to find someone to act as a co-sponsor for your visa. Unless you have enough funds of your own to self-sponsor. You need to have someone who make 125% of the 2007 Proverty level.

Do some research using the guides above and you will get thorugh this process with relative ease.

They dont care where the form is mailed from, but she must have a US address where they will send all correspondence. It has to be paid for in US funds, and she will need US source income or a co-sponser.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

another question has cropped up in regards to your answers.

125% above poverty, i have looked through the figures and i am coming up with about $12.5k? so if i have this much in my bank at time of application, then my GF wont need to put a co sponsor down?

im sorry if i sound stupid right now, im terribly exauhsted.

Would it be wise for her once the ball is rolling, to go back to the US and start working so she wouldnt need a co spnosor?

Does anyone have any links to info on the sponsorship level? i am looking on the USCIS website and cant seem to locate this specific information.

Again, i really appreciate any help.

Just a word of warning, if the K-1 visa is approved you will still need to provide an Affidavit of Support for Adjustment of Status, so at some point she WILL need to find you a co-sponsor. As far as I am aware you cannot self sponsor for AOS (correct me someone if I am wrong!).

So, find a co-sponsor if you can, it WILL be needed at some point of your journey.

Nope. Time to start studying the guides. You're months away from needed to have an affidavit of support handy. The sponsor needs to earn the minimum 125% of poverty level for their household plus the intentending immigrant. The number for a household of two is a little over $17,100 and it goes up from there. Assets can be substituted but for a joint sponsor would need $5 in assets to cover each dollar of income shortage. There's really not a place $12,000 of your money is any real consideration when it comes to sponsorship.

It's 3 to 1 when sponsoring a spouse. A joint sponsor is not sponsoring their spouse, so 5 to 1 is correct for a joint sponsor whether for a visa or AOS.

Self-sponsorship (which is what the OP asked about) is not joint sponsorship.

The OP doesn't qualify to self sponsor, so I didn't address how somebody else might qualify to self sponsor. The statement about 5 to 1 comes in my description of how one would qualify as a joint sponsor. Actually, I don't see where the OP asked about self sponsoring. He just made an obscure statement about how his savings might help his fiancee qualify.

In any event 3 to 1 is correct for sponsoring a spouse, not correct universally for AOS because even for AOS sponsoring a non spouse is 5 to 1.
