My fiance and I are about a week away from filing our K-1 (finally!) and I find myself in a position now (being the petitioner) where bankruptcy is looking like the most viable option, will this effect our K-1 request?

I assumed the request only looks at income (I am employed full-time with a salary that exceeds the specified support limits) as documented in the Affidavit of Support, but I don't want to take any action that is going to preclude or delay our K-1.

Petitioner financial situation is not considered until the visa interview when you have to provide an affidavit of support, at that time you can use a co-sponsor for the K-Visa, and later when adjusting status you can use a Joint sponsor.

So no it wont affect the petition.

You have to check the povery guidelines for 2007,if the amount of money you earn is not enough you can go for a so called CO sponsor.

Yes, I am well over the guidelines as listed, I just wanted to make sure that income was the key and not debt.

Yes, all they want to see is income. You could be millions in debt. It does not matter. Still no credit check requirement for a fiancée. :lol:
