Visa travel question...

Hello all,

J's K1 visa interview was approved on Sept 10, 2007. J wants to attend a graduation for her sister in CDO, Philippines, in February 2008 with me, and I was wondering if this later travel date to the USA would be a red flag come AOS time, or would it be OK? I would imagine the expiry of her K1 visa to travel would be around March 10, 2008. Anyone with suggestion or experience with this, please post and let us know if this will be a problem or a red flag for AOS. Thank you.

dj1206,

If travel/entry to US occurs within 6 months of the visa date - there is no problem -

Thanks for the responses. J knows somebody else who also recently got approved, and that person told her that it "was not good" to use the Visa with less than a month left to go before its expiry. I tend to agree with your answers, but I just wanted to hear it from somebody else than me! Regarding AP, she wouldn't be traveling back to the RP to see this...this is before she comes to the States, so AP wouldn't apply in this case. We'd just be potentially shaving things a little close in terms of the visa validity dates, and we just wanted to hear from someone else other than ourselves (haha) who could shed light on this and help us out. Thanks again

It is people that your SO's friend spoke with that create frenzy and should be stopped :)AOS only cares that you have basis to apply to adjust your status...... They could care less when you arrived....

YMMV

  • 2 weeks later...

It's interesting that when Annie had her interview, she told the pre-screener that our plans were for me to be in the Philippines for Christmas, and then us flying back together in early January. The pre-screener said "That's long, it is not good for you to wait so long". Which of course made Ann nervous.

Her visa was signed on September 18th, and she received it on September 20th. I'm guessing that means she would technically have until March 18th to arrive in the USA.

So sometimes, it's the bad information being floated around right inside the Embassy itself.
