Calling USCIS as non-USC's spouse

Timeline

Is there anyway around talking to an IO either on the phone or at an infopass without my hubby (who is adjusting status)? I called today and tried to find out about his case and the IO was a major BEOTCH and told me no way can she speak to me about my hubby's case - although I'm his spouse/petitioner/sponsor.

Is this true? Is there a way around this?

My husband goes to work at 6:30 a.m. everyday and doesn't come home 'til the evening. He just started his job (thanks EAD!!) and can't imagine his boss giving him time off to go to the infopass.

Can I do anything?

A written letter of consent should work.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

I have always handed the phone to him when we were in the same place, but when we were in different locations I always had him on 3 way calling. Also you may be the sponsor, but not the petitioner he is the applicant. This is his case only at this point.

3 way call sounds good... or if you go to an infopass appointment bring a letter like this (one I filled out for my senator's office):

PRIVACY ACT RELEASE FORM

I am aware that the Privacy Act of 1974 prohibits the release of information in my file

without my approval. I authorize the USCIS to provide

information on my case, receipt # (put case receipt number here) to my spouse (put name here)

USCIS also has a privacy form, but it's somewhat more confusing and a written letter is acceptable.

Thanks so much!

I know that this is case from now on....it wasn't so much that the IO told me that she couldn't talk to me - it was that she was so rude about it. I can accept that USCIS won't let me because of the privacy act, but I think it's fair to allow the petitioner's spouse speak on his/her case, but that is IMHO.

We'll try the 3-way calling next time - we'll just have to make sure that his boss doesn't mind that he's on the phone for 5-10 minutes. I think we'll be ok.

Once I have permission to talk to the IO then I'll ask if the written consent is acceptable.

lol good question :D ... i would guess (omg bad word) that since they use the case numbers to look up files, they could speak to you regarding the I-130 since you are the petitioner for that file, however it wouldn't make sense to then turn around and say - I-485 nope nope we won't talk to you! USCIS though... :P

I really don't know - I was always able to speak for and call on the behalf of my fiance during the K1 process (me - petitioner), however I have never been able to speak with a rep on his behalf for his application to AOS.

They will not speak to you without your spouse there to give permission. The IO even told me that I could not put a letter on file giving me permission so my spouse did not have to be around. From reading above this part seems to be incorrect. Any ways the IO told me not all spouses are nice like me and some would like to sabotage the case of the applicant.

I was always allowed to speak to USCIS about my husband's case (when it was K1) but I think that makes more sense to them since most likely your fiance is not even in the country yet.

I won't bother with the letter and will try the 3-way calling... Thanks.
