Judge blocks “no match” letter rules in labor suit

August 31st, 2007

A federal judge Friday blocked the U.S. Department of Homeland Security from enforcing new rules that would hold employers responsible for probing the immigration status of workers whose Social Security numbers don’t match their names.

The ruling temporarily blocks new rules issued this month by DHS to crackdown on the hiring of illegal immigrants but which labor unions said could lead employers to fire people who have a right to work if their names and numbers don’t match - just to play it safe.

Judge Maxine Chesney granted the temporary restraining order in U.S. District Court in San Francisco two days after the AFL-CIO and several San Francisco unions filed suit. A hearing on the lawsuit, which is supported by the ACLU, is scheduled for October 1.

Because you have changed your name (as millions of Americans do when they get married, for example)

and forgot to notify the SSA?

Because you have changed your name (as millions of Americans do when they get married, for example)

and forgot to notify the SSA?

even if you notify the SSA.. my wife has 2 different names.. her SS card has one name.. SS supposedly notified IRS about the change, IRS says they have a different name of hers (in SS she has 1st Name, middlename-maiden name, my last name), in IRS she has 1st Name, Middle Name, Her last name-My last name. and they can't fukcin figure it out.. fortunately she's the USC and doesn't have to mess with DHS too.

SSA/IRS/DHS are all incompetent and should have no authority to disallow anyone from working.

Heck, they shouldn't even be allowed to levy taxes till they figure out how to do it right without fukcing up.

I suspect the efficacy of the law would have been low anyway. The employers had ninety days to verify the information, and then if it didn't match, to fire the employee if it wasn't resolved or risk another fine. That's an awful lot of undocumented short-time work.

And it does seem a little off to make the employer responsible for verifying someone's information when they're, you know, not actually in possession of the social security database.
