I was wondering, IF Tasha and I, have all our proofs together, in other words, we have all the law is asking for, can they actually say no to me at the interview?

Gus, if I had the answer to that question I would not be freaking out about my own interview - this is the million dollar question indeed, and I have no answer. Read up on waivers as well, just in case.

You can have the answer. The questionis "can they...?" not "will they...?" and the answer is yes.

The marriage based visa process is quite subjective in many respects. While it is critical to fulfill all the requirements, the Consular officer must make subjective judgments in several areas. The most critical of those judgments is about whether the relationship is bona fide and ongoing. That's mostly subjective, so it's best that you approach the interview with that in mind.

Because if you get married in Columbia, you can't come to be with your fiance to wait out the adjustment of status process. Most people (at least me and my husband) applied for the K-1 because of this reason. We had actually planned to get married in Germany back in 2005 but knew if we did, I'd end up waiting for the whole thing to finish up without him. The fiance visa allowed us to be together for the rest of the process.

Hello everyone, Well, I'm new in this forum, but I'm here to stay.

We had gone to a lawyer, to start my K1 Process, but we've decided to do it ourselves, thanks to this forum.

I've been reading alot, but now I think I'll be needing some advice:

This is my story:

I live in Colombia, and I've always had my tourist visa, but on 1999-2000, I went to miami, Fl. I stayed there for 5 months 10 days. ( I had a 6 months permission to stay). I came back to Colombia, and went to the US Embassy to get my tourist visa renewed. They stamped my Passport with a ""Application Received" stamp. They told me they were not going to issue me a visa that day. Months later, I applied for a student visa. I got another ""Application Received" stamp. I was told by the consul to study here for 2 years, and then apply again. I did, and I applied for the tourist visa 2 years later, got another stamp! The last time I Applied for the tourist visa was on August 2005. Got another stamp.

I've known Tasha for 10 years already, But when she came here on june 2007, well, we fall in love. (yes I love her). We've decided to get married, so we are starting the K1 process.

we have plenty of proofs of us meeting, and of our relation. I'm afraid, when the interview day comes, they ask me :

Why don't you just get married in Colombia?

If you go marry in the US, will you stay there to live?

I don't want the consul to think, I just want to go to the US. I will still live in Tasha's house

PD: I have no criminal records.....

It is at their discretion but only if they don't think your relationship is real so be sure to have all kinds of proof. I brought airline tickets from when my husband came to see me in Germany, cards he gave me over the period of 4 years, emails, telephone records from both of us, pictures of us together, etc.

And to ease your nerves just a little bit, I had a folder FULL of evidence and they did not ask for one single thing! I didn't even have an interview for the K-1 because the officer didn't ask me any questions! After I showed them all of my pares and stuff, the officer who was supposed to interview me just asked me if I was ready to go be with my fiance. I said yes and he said okay, have fun in the states!

I was very disappointed that I could NOT show them all my evidence LOL.

Yeah, I will get married, probably 2 weeks after I get there, and get things ready, I mean, Is there anything wrong at all, to answer the CO, that we are going to the K1 process because it is the fastest way to be together?

Before applying for a fiance visa, I had applied for a tourist visa twice, and a student visa once, and got denied. But I didn't have problem at all with K-1 :) of course, by the time my fiance (now husband) and I applied for the K-1 visa, we'd known each other for 7 years.

I've known Tasha for 10 years already, I can proof we went to the same school.

Our relation started this June 2007 though....

I don't think anything is wrong with telling them that. The faster you want to be together just shows your determination to be together.

It might be the fastest way for both of you to be together, but you should take into consideration that it also requires you to get married so you have got to be ready for that. Also, it's not the final step you need to do, once you're in and married, you will have to file AOS, and then remove conditions. Hey gchagui;

You are being too paranoid. US consulate in Colombia (Bogota) is very good in giving out K1 and K3 visas. Few are denied and those that are denied normally do not have the documents asked for or enough support (monetary). My wife is from Colombia and she was a little scared at first (she was denied a tourist visa 2 years before her K1 application). She called me from Bogota after the interview and said - "It was very easy." There is a thread for Colombians on visa journey and they can help you in Spanish or English with documents you need and what are the steps you will need to take.

Keep in mind - relax; do it slowly - one document at a time; don't worry. You can answer all questions truthfully - e.g. Yes I will be working in USA. Yes I will stay with my fiancee (wife) or her parents till I can find a job and support us both etc. etc. There is nothing wrong with that. You are migrating to USA to live - to study or work or start a business or all of these. Tell them of your plans etc. but only if they ask for it. Good Luck

I was also pretty paranoid because my previous visa application experience was unpleasant. But my experience with K1 was nice and very fast. The interview only took about 5 minutes or less. Just bring in emails, letters, pictures, phone records. My interviewer only asked for some pictures and times of our visits to various places together. There weren't any questions about intents (which are already obvious).

I know it's a hard thing to do, but don't worry too much. :) My husband (fiance at the time) and I went through every possible question plus more, too. Has your American fiancee ever lived in Colombia? Does she speak Spanish? Does she like Colombian food, customs, culture, way of living enough to live there for the rest of her life? For us, my husband had lived in the US for 2 years on a different visa. He's fluent in English, familiar with American way of living and American food. Moving to the USA would make him sad to leave his family behind and he'd be a bit sad to leave his country and culture, but it wouldn't be as big of a deal as me moving to France. I don't speak French yet, I'm not a huge fan of French food, I don't know French culture or way of living. For me to move to France would be a huge undertaking, and it would be so terrifying for me, and it would be devastating to my family. But his family's used to it because he had already lived in the USA for 2 years, and he's not as close to his family as I am.

So if, at the interview, they had asked my husband "why don't you just get married and live in France" our answer would have been what I said above. And plus his family are all accustomed to flying trans-atlantic, they could make it to an American wedding. My family is scared silly of planes, they'd never get on a flight to France, but they'd be devastated about missing our wedding.

There's so many reasons that pointed to him moving here. What are the reasons for you?

If you're wondering, at my husband's K-1 interview they asked very few questions and looked at very little of the evidence that I sent (which weighed 2 pounds in its binder). He was in and out of the interview quickly and painlessly. :)
