Hey ya'll , I was married in 2001 to my Mexican husband. I petitioned for him but her never got a green card. Just approved I-130 and a K-3 visa.

Our divorce will be final on August 29, 2007. I met someone during during the last year of my marriage online. He is from Morocco.

I stopped the process for my ex husband so now he gets no green card. ( he had it coming in case you are wondering)

My Question:

HOW WILL THIS AFFECT ME IF I WANT TO PETITION FOR MY FIANCEE IN MOROCCO?

I NEVER WENT TO ANY INTERVIEWS WITH IMMIGRATION OR OTHERWISE FOR MY X HUSBAND.

WE WERE DEALING WITH AN IMMIGRATION ATTORNEY WHO CHARGED US 5,000 DOLLARS BUT THEY CLOSED OUR CASE BECAUSE OF OUR DIVORCE.

PLEASE ONLY COMMENT IF YOU ARE KNOWLEDGEABLE ABOUT THESE THINGS. I WOULD REALLY APPRECIATE IT. THANKS.

The only real difficulty I see is that you have a fiance while you're still married. I'm making no judgment but this "fact" is a potential issue for you to address either in you plans or at interview or both. Your new "fiance" is from a part of the world where all visa applicants get extra scrutiny even more for males. The fact that your relationship began while you were still married is going to bring extra scrutiny, if you file right away and indicate your in person meeting occured on a date prior to your divorce.

You would be wise to be prepared to provide evidence of your ex-husband's residence apart from yours and his social security number, if any. All this will can be made more difficult if you have a low income. Each element I described tends to fit a common fraud profile, so you should be well prepared to show bona fides with the new man and separation from your former spouse.

Facts are cheap...knowing how to use them is precious...
Understanding the big picture is priceless. Anonymous

What Pushbrk said.

I mean you married and brought in someone through a K3 and then divorced them. There is no time in between the divorce becoming permanent and your K1 for a new fiancee.

That raises ref flags all over the place on both counts.

My female cousin brought over her husband from Turkey I believe. I know it was a Muslim country. Took her almost two full years and one year was in Administrative Review.

I would definitely wait until several months to petition for the new spouse or fiancee. You need to be completely divorced and you need explanations as well. It is possible but be aware that Morocco seems to have a tough scrutination of spouses and fiancees. This country seems to have a high reject rate of petitions due to suspected fraud ( I dont thnk thats fair..but its happening)
