Hi again. My fiance and I have visited eachother several times this year, and filed our K-1 on July 28 2007. Assuming USCIS rceived it...

...If I wanted to visit my Fiance in Florida and/or his sister in Boston mid-September, *how soon* would the border have been notified of the K-1 petition ap?

Would the border's knowledge of the petition be affected by how I crossed? ie.

-drive through (the best option for me because I want to bring my dog)

-Greyhound bus (return ticket)

-Airplane (return ticket)

I do not intend to stay, but I don't want to get into a hassle over the K-1 at the border either.

Thanks! CB

Both myself (K-1) and my daughter (K-2) travelled by car from Canada to the U.S. several times while our applications were pending with no problems.

I would suggest that you take any evidence of proof of ties to Canada with you, such as mortgage/lease documents, your most recent pay stub, a letter from your employer giving the date they expect you back at work, etc.

I would also suggest that you answer the border officer's questions honestly, but don't even volunteer the information about you having applied for the K-1 Visa, unless they ask you about it. When they ask the purpose of your trip, tell them you are going to visit your boyfriend (or your boyfriend's sister) and then they will probably ask you when you plan on returning to Canada. At that point, they may ask you for proof of ties to Canada to prove that you intend to return to Canada after your "visit" to the U.S.

I was asked if I had ever heard of the "Fiance Visa", and I told them that yes, I had, and we were awaiting approval. Neither my daughter or I were ever denied entry into the U.S. while our cases were pending.

Good luck.
