Hi,

my wife USC does not meet requirement for supporting me even on basis of her assits and income.she has an uncle who earns $ 80000 per annum and he meets requirement to support me . Can he be my sponsor for adjustment of status(1 485)

;one more question does my wife need to be sponsor along with that uncle or his uncle can sponsor me alone.?

Your wife needs to be your primary sponsor in ANY case, but yes, the uncle can be a sponsor as well and this should cover you over and above what you need (by plenty) from the sounds of it. It won't matter if your wife's income isn't sufficent if her uncle is able to help out. He does need to meet the income requirement on his own(not combined with your wife), but it doesn't sound as though that would be a problem...if he makes 80,000/yr that's 3 or 4 times more than what is needed. If he's willing to do this, sounds like your problem's solved! Best wishes!

Exactly. So BOTH your wife and her uncle will need to fill out separate I-864s for you for AOS, even if your wife has little or no income. If she hasn't been required to file taxes, she needs to write a statement about why to attach to the I-864 too.

Your wife needs to be the primary sponsor regardless of whether she makes the income requirements or not. However, if she doesn't make the requirements as you've noted, then she'll need someone to be her joint sponsor. That person must be a US citizen or permanent resident type residing in the US, who otherwise meets all the requirements listed in the form. Documentation for both is necessary.

so my wife ( not meeting sponsorship requirement) and my uncle (meeting sponsorship requirement) will file 2 separate I 864 forms. So does both of them need to write any cover letters along with that, and if yes, then what my wife is going to write in cover letter as she does not meet sponsorship requirements and she even does not file for tax too?
