I have seen posts that on the off chance they do check for the I-134 at the interview they have been looking to see if the 125% poverty guideline is met. I know for I-134 it only asks for 100%. 2024 and 2025 I did not meet the 125% due do taking unpaid time off for a LOA (2024) and traveling (2025), but I have more than enough in assets to cover the difference in stocks. In 2023 I took no unpaid time and just barely squeaked by the 125%, so I guess my question is, should I bother attaching my tax transcript for 2023 and is any kind of explanation necessary? Same employer and I have gotten a raise since 2023, I may be overthinking things, but I want to make sure Aye has everything she needs. TIA

Submit the IRS transcripts for the past 3 years. Your most current proof of income like payslips, employer letter, etc. is the deciding factor. You can add assets, etc. If your income is not or barely 125%, then consider co-sponsor. My personal suggestion is more the better. I-134 is just for the consulate to make a decision. But the I-864 is what will be legally binding.

stop thinking about 125% till you do the AOS here in US after marriage

you can submit a letter from employer with start date and current salary showing continuous employment

if you do not meet the 100% the embassy can ask for joint sponsor so prepare for this if needed

If your assets can be easily converted to cash within a year, you can provide them

Do you have a link to show 100% of the household poverty for I-134?

I've only seen the 125% for I-864. A quick search with Gemini says "While some cases may accept 100% for I-134, aiming for 125% is safer, as it aligns with the stricter requirements for Form I-864."

I cannot find anything from USCIS about the 100% just anecdotal and what some law firms have posted online. I am most likely over thinking everything. The assets I am sharing are 30x the difference.

I am most likely overthinking everything. I easily meet 100% and on the fringe chance they even look at the i134 in Manilla we should be okay.

Feb 28, 2025  Use the HHS Poverty Guidelines to complete Form I-864, Affidavit of Support Under Section 213A of the INA.
