Hello- I am hoping someone who knows the K-1 process is able to help- we have filed for a K1 as of March 2025, we received a RFE in December and even though I am working with an immigration attorney here in PA, he hasn't been any help and I need to do research on my own.

 

For our RFE, my Dominican Fiance was asked to provide an Acta Inextensa for proof of his divorce (he sent in an Extracto De Acta De Divocio).  The Inextensa is requested because it is more detailed and has more information.  He went to the local records office in the Dominican and was told that as of July 2025, they no longer have a Acta Inextensa and now only have 1 option which is an Acta De Divorcio.  

 

I'm concerned if we send this new document and not what was requested it will not be accepted for the RFE.  Is anyone familiar with this in the DR?  Is there anyway to get the older document?  PLEASE HELP!!!!

When was the divorce?

there is a requirement for those before July 1,  2025

Comments: As of July 1, 2025, certificates of birth, recognition, marriage, divorce, and death have been unified into a single format, eliminating the "extract" and "inextensa" distinctions for these documents. However, for immigrant and K visa applications, the U.S. Embassy in Santo Domingo still requires the “Acta Inextensa” for older versions of these documents issued before July 1, 2025, as it provides more comprehensive information. Applicants may also submit civil documents issued after July 1, 2025, which no longer include "Inextensa" or "Extract" labels. Legalization of Dominican civil documents is not required for visa purposes.
