Hi everyone, 

 

I currently have a pending K1 Petition for my Fiance in Algeria. With everything going on with the trump administration, what are the possibilities that he will be denied AOS here when he applies? Also, I heard this new thing about received government assistance by the petitioner anytime in their life will affect their AOS process. Not sure how true this is but it left me worried because I was received govt assistance all my life growing up and during college i received food stamps. Any advice helps. Its been about 5 months since the application has been pending. No RFE's or nothing yet.

The petitioner having received public benefits will have no effect on the AOS process. For the K-1 to AOS, marry within the 90 days AND file your AOS application within the 90 days as well would be my best advice. As long as you submit your marital bona fides and your husband is not otherwise inadmissible at that point, you shouldn't have an issue.
