I am a US citizen, I will turn 21 in another few months. I am currently studying in college. I would like to sponsor my father's greencard, he is currently in US and on L1B visa. My father is from India, but I read that there is no wait time for immediate relatives so I believe I can file i130 AND i485 together. Also, my father already have 40 work credits from social security, so I think I can be exempted from financial sponsorship evidences. Need guidance and support from experts in this group on my assumptions and the next steps. Thank you all for your help.

Yes, you can absolutely sponsor your father for green card. He's an immediate relative of a US citizen and there's unlimited visas available for this category.

 

File I-130, I-130A, I-485, I-693, I-864. Also optional I-765 and I-131.

 

Sometimes, even with 40 work credits USCIS ignores it. So make sure to attach proof of 40 work credits, maybe a statement from SSA.

Thank you for the quick response. I believe i864 is for affidavit of support, but as I mentioned earlier I am a college student and don't have a large income to show. My father is working in US and has 40 work credits. My primary residence is the same as my father's. Can I just use 40 work credits alone and waive off the affidavit of support or can I have him provide the evidence of support or both? Please advise.

Read the pdf instruction sheet on the uscis website. It lists clearly the exemptions for i864. Having 40 plus  SS credits is listed as an exception.  Follow the instructions when filing to explain why there is no i864 attached and includes the official SSA statement

Thank you. Will it add more merits to the application if I have my father provide the financial information besides the 40 work credits? I am just trying to check if there will be a situation where the i864 waiver may impact the outcome. Any experiences or observations on this?

No. The exemption from needing to have a sponsor completes the  financial requirements
