Hello!

 

My husband will be applying for both of his parents at the same time (separate I-130s). However, we got confused on the question that asks "Have you EVER previously filed a petition for this beneficiary or any other alien?". If we were to submit his dad's I-130 and then a few minutes later, submit his mom's, should we answer Yes to this question on his mom's I-130? If so, it goes on to ask "Where was the petition filed?", it asks for a city and state. What do we put for that if the only other petition filed was his dad's?

Technically you would answer yes for the second petition you submit, and put down your current address.  In the end, it probably does not matter.

By definition you cannot submit two cases at the same time. Just like with two twins being born. One is ahead the other. So after first kid born your answer "Did you ever give birth?", the answer is "yes". Same with petitions.

Okay, thank you. How should I answer the next question, where it asks "Where was the petition filed?" It's not a mandatory question that has a red asterisk, but I'm not sure if I should put a location or not.

Looking at the form, this is in Part 5.  Relative to 1-5 in that section, I would leave that as “NA”, and then put each parents name in items 6-7 in that section.  I am not sure how the online form is set up relative to the paper form, but those items should be there.  It appears Part 5 items 1-5 is more about petitions that have been filed in the past and were either withdrawn, approved, or denied.

This also avoids any confusion if they process the applications out of order.  They try to do the second one that refers to the first, then can't find the first because it hasn't been entered yet.  It's nit-picky.

 

Remember to keep track of both of them.  Ideally they will process through in the same time frame.  But there have been stories on here.
