Hello folks, finally got my interview letter for N400. I filed on 5 years rule though I am a LPR for 9 years. Removed condition in 2024 October with Good faith marriage waiver. I have few questions if you guys can help with:

1. I have 5 traffic citations back from 2015 to 2022 where all were speeding violations and have been paid off. I do not have any court docs for them. I disclosed them in N400. Do I have to get any dismissal paper or court docs for them?

2. I was divorced from 2017 to 2021 with my ex wife through whom I got GC. I got married in 2021 and mentioned everything in N400. Do I have to take Naturalization certificate of ex spouse, divorce decree and 2nd marriage certificate? My perception was since the condition was approved so the GC will be sufficient. 

3. I was arrested in 2015 (10 years ago) for charge of shoplifting under value 100 but later the case got dismissed without conviction for me and my accompanying friend actually got convicted. But we both were arrested initially. I have court dismissal docs for this case. But just worried if this will bar me from naturalization or not. I got my conditional GC and later removed condition after that event though. 

4. My initial understanding was- I need to take interview letter, my original GC, current and previous passports, 3 years tax documents, and shoplifting arrest dismissal paper. Do I have to add any further document for the interview? Or am I missing anything? 

5. I heard a lot of times interview and oath ceremony happen same day on the USICS site. I have small name change request. Any chance for same day oath if my case gets approved? I am an Orlando, FL filer.

5. I wouldn't expect same day ceremony in your case. It's not a squeky clean case and it may take time to adjudicate. Also, from what I know, any name change results in ceremony being held on different day.

 

Do you have a lawyer representing you or are you going on your own?

I'd be a bit hesitant to do this on my own with all of the potential issues with case.

The only overall wrinkle may be if ex got GC from marriage too. USCIS may dig a bit deeper on this

My ex wife got naturalized through her dad when she was 10 or 11. I think she came here with GC first around 11 and later naturalized around 14-15.

I am doing on my own. When you said potential issues, which ones you are referring to?

I had none of these, and I still took a lawyer with me. I guess everybody's risk tolerance is different.

Ok, since you have approved I-751 it may go easier. But still, don't get surprised if they want to ask more about that marriage and reasons for divorce. They shouldn't probe too much as you're filing independently, but they attempted to do at my interview, even though I'm married. Attorney stopped them from spiraling out. Make sure you have good answers and know the timeline.

Thanx for sharing dear. I will take my whole i751 waiver file with me then. Add new marriage certificate. Also tax returns and arrest case dismissal copy. I could not locate my ex wife's naturalization certificate but I got I130, I485, and later I751 approved. Idk what will be rational to spiral around old memories and the docs which were checked before. Let's see what happens.

The reason they have multiple interviews throughout immigration is to check everything multiple times and avoid mistakes. Although rare, sometimes even prior decisions can be revisited and reversed.

 

You'll probably be fine.

Speeding tickets should not be issue where they have been paid in full. Plus last ticket was in 2022 which lapsed 3YEARS. 

The arrest was for a charge which ended up with no conviction and 10 years old. I heard USCIS looks 5 years from filing. 

My marriage was in good faith and genuine. I literally got done I751 interview in 6-7 mins. Instead I asked the IO if he wants to know more about marriage and divorce. He said all good. I got GC in 09/2016 and divorced in 11/2017. Married in 09/2015. I can answer as much as I can but I destroyed a lot of good faith evidences (specially photos, letters, cards) after I751 was approved because I was tired of holding our dead memories.

With the name change request,you won't have same day oath ceremony bc it has to be approved by a judge.I wanted to do so,too but at the interview the officer said: either same day oath without name change,or wait months ( in my case) and take oath AFTER the name change🤷‍♀️I wanted to be done- so I skipped the name change and had same day oath ceremony 😊

Can I choose to NOT TO CHANGE name during interview and go with same day OATH if possible? I have very limited PTO left and my director already pissed on me for my month recent long vacation. I do not wanna make too frequent time off requests
