Hi all,

 

I hope everyone is doing well.

 

My wife and her child entered the U.S. as a K-1 and, her derivative, K-2, respectively.  We would like to go on a trip domestically.  Their I-485s are pending, and my wife has had her EAD come back, she has her work authorization, but her son doesn't.

 

My concern is that REAL ID may have changed the expectations of what ID they need to fly with.  Our son's I-485 AND I-765 are still pending, so in both cases their passports have visas that have expired, and their I-95s expired.  Would he need to travel with his NOA that says they are processing his I-485 in order for his passport to be a "real ID" or is the passport only a real ID if it literally has an unexpired visa and I-94?  What would he need in order to fly?

I know there isn't much to fear in terms of the immigration, I am more worried they wouldn't let us board the flight because they would say that they need more documents for their passports to constitute Real ID.  Note --- he's less than 2 years old

Passport is a "Real ID" no matter the status of the I-94. I would carry a copy of the NOA1 in case he is questioned about his immigration status
