Yes it makes sense and I want to extend my gratitude to you for taking the time out of your day to respond to me. To be honest with you I was worried that uscis is taking forever to process my i765 application only to find out that it was submitted under the c31 category. I just realized that on Friday of last week. My vawa application has been submitted 20 months ago.

But how can I find out if I’m in the court system if I’ve don’t have a case number on my A number?

Let your attorney handle this. or do FOIA request to USCIS or call the court to get the information or call this number to see if you get any help.

You should apply for EAD based on C 14 ( deferred action ) based on the prima facia ..

I called the number it says the a number that you have entered doesn’t match any information in our system or hasn’t been filled with immigration court.

so do the FOIA request. This will give you all your documents. However, this would take 4 to 8 weeks.

I do not think he can file based on Prima Facia. His best option is C09 since he has i-485 pending.

It sounds as if NTA was not filed with the court ..but the I-131 denial wording shows I-485 underlying apps treated as if . 
Ideally Once VAWA approved , you will need to Motion Court to terminate then notify USCIS to resume I-485. ..BUT I would file with the Court to Terminate Now based on prima facia ..before possible administration change . ..just to create record , even if filing bounces around

Thank you for this, very helpful. How do I go about starting this up, can I do it myself or I have to ask my lawyer to do it, because from what I noticed everything is about money for them when I’m already going through hardship as we speak

He will get c09. It happened to friend of mine. His i-131 was denied but his EAD got approved. OP has i-485 pending so he is good to go when it comes to his EAD. He will not get AP because of removal.

If i were you i would wait until VAWA approves. Do not send court paper work without lawyer.

Go to your Congressman and ask for expedite on current C 09 filing plus any answers on I-131 denial for removal
