AOS filed to incorrect Lockbox - Fee increase?

Hi all,

 

Thanks for the wealth of information posted to the forum.

 

I recently filed my AOS (with EAD and AP) but found today I'd accidentally filed to the incorrect lockbox.

 

I've done some reading and found it can either be transferred to the correct lockbox, or returned to you.

 

With regards to the AOS fee increases, does anyone know what fee amount would be expected if the case was transferred to the correct lockbox by USCIS, and received there post-fee increase?

 

Do you guys think it might be a better idea to just re-send the full package to the correct lockbox without hearing anything back from USCIS first? Might this cause some case duplication trouble down the line?

If I wait to hear from them, and they just return my documents it's likely my re-filing would be post-fee increase, which I'm of course trying to avoid!!

 

USCIS livechat+phone agents are only able to tell me "Wait to hear back from us", with one livechat agent rudely writing "Why would you file again if you haven't heard anything???" showing they don't understand the point of my line of questioning at all, haha :)

I would not do that.  USCIS will rely on the postmark to determine if the fee increases apply to a particular case.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

This is really helpful to know, thank you.

 

It seems like it's a toss-up whether they'll forward it internally or return it to me, though.

If they were to return it to me, it seems likely it would result in me re-sending my package to the correct lockbox after the 1st of April, the day of the fee increase.

 

I know it's my fault for not double-checking the correct address, but am I just in a 50/50 situation on how it will play out?

 

What do people think is the best action for me to take?

I would let it ride as is.  In the case that I can remember, they were processed.

It’s a tough call. I assume you have tracking info on its delivery, so try emailing lockbox support to locate it. 
 

If no luck in the next 10 days , I would send in a new filing and stop payment on presumed lost first packet. 
If they reject /return your first packet , postmark of attempted filing won’t help you. You will need new forms and new fees

  • whether we received your application/petition if you filed more than 30 days ago and you have not yet received a receipt notice.
  • a recent filing at one of the four Lockbox locations.

We will answer each email in turn as soon as possible. Please include the form number, receipt number, petitioner and/or applicant name, and mailing address with your email.

Do not include social security numbers in emails

Turns out we have a good ending, and I actually filed to the correct place in the first place. Panic over!

 

Edit: Panic reinstated, I did actually file to the wrong place. I'll be following the advice from Family, wish me luck

We sent the package to the Lewisville, TX lockbox (FedEx), which was incorrect as we live in Nevada.

 

The rollercoaster is over for now, though, as I got the texts today to say AOS, EAD, and AP were accepted with receipt numbers, and NOA1's to follow :)

 

My wallet is thankful
