rfe for AOS resets the clock for EAD?

So i received and rfe for my husband to resend his w2/tax info..guess they lost it or something. On the notice it also says that approval of my EAD cannot be submitted until 90 days after the requested info is received by them.Based on when i sent my entire package out,i was expecting work approval by mid October. Now it won't be until December. I almost lost it- I know it's only an extra month and a half or so.. but i'm going nuts with nothing to do everyday and really need to start working-so that extra time feels like forever. Anyway,just curious if anyone else has been upset by something like this..and if miraculously anyone still received it on the expected date anyway?

11/22/06- entered US as a visitor from Canada

05/04/07 -married

06/28/07- AOS/EAD/AP- mailed

06/29/07- package received

07/09/07- checks cashed

07/10/07- NOA1 for I-130

07/12/07- NOA1 for AOS,EAD

07/12/07- biometrics letter received

07/13/07 -rfe payment for I-131 ,wrong amount

07/14/07- touched-485 &130

07/17/07- rfe sent for I-131

07/21/07- rfe for W2s/tax info..guess they lost it

07/31/07- biometrics appt

08/01/07- EAD touched

08/07/07- rfe sent for 485

08/10/07- rfe received,485 processing resumed

08/22/07- receive letter for interview 11/20/07

08/25/07- AP approved and received

09/07/07- EAD card received

10/17/07- received SSN (took about a week after applying)

11/20/07- Interview- more evidence requested

12/14/07- Evidence submitted.....waiting...

12/26/07- Approval notice sent/ Card production ordered

In practice it doesn't actually reset the clock, despite the dramatic wording. Most people who have RFEs, if they reply to the RFE promptly, still get their EAD in around 90 days.

We got a RFE on my husband's AOS but card production for the EAD was approved on July 20 after filing AOS & EAD on May 4. So it looks like 90 days is a good estimate for the EAD even with the RFE.

Married : 08-04-2006, Cumbria, England

09-01-2006: Filed I-130 application

09-18-2006: NOA1 received

01-31-2007: NOA2 received (by email)!!

I-129F (K-3)

09-19-2006: Filed I-129F application

10-13-2006: NOA1 received

01-31-2007: NOA2 received (by email ... by mail on Feb. 5)!!

02-13-2007: received at NVC and sent to London Embassy

02-16-2007: received by London Embassy

02-27-2007: received and mailed back Packet 3

03-12-2007: Medical completed

03-15-2007: received email from Embassy providing interview date

03-19-2007: Packet 4 received by mail

04-18-2007: interview - approved!!!

04-21-2007: visa delivered

04-24-2007: husband arrives in US

04-27-2007: to civil surgeon for vaccination supplement

AOS & EAD

05-04-2007: Filed I-485 & I-765

05-11-2007: NOA for both (received by mail May 15)

05-16-2007: notice mailed for biometric appointment (received by mail May 21)

06-07-2007: RFE - USCIS can't find medical results - we have to return to civil surgeon and pay for another appointment

06-13-2007: biometric appointment

07-20-2007: EAD card production ordered

12-13-2007: interview & approved

Ok well that is relieving to hear...thanks....i don't have a car,so job hunting in the middle of Chicago winter is not exactly my idea of a good time..sooner that comes in the better!

My clock was NOT reset. EAD was granted without delay.

Well, my nightmare just got worse!

I received an RFE a few weeks ago... I know, I know...

send your info in promptly!

I sent it in Nov. 7th - Certified - on usps' website they only

have a record of receiving my package.

Now that it has been a week, I decided to speak with a person - 1800- usps...

They are telling me - that they can not track my package and I should have

sent it Express - if I cared enough about the package...

Mind you that package holds my medical - that I spent about $400 and change on it...

* I just shook my head - great!*** (solution - I may have to resend it) - I hope my 90 days are not up as they

are waiting for this package! LOL

It can take weeks for them to input RFE into the system. You're still safe.
