Need to wait for PSA marriage cert to file online i130 or can add later online?

searched first but found no current answer, thnx.

 

If we file online i130 a day after Mayors marriage in PH and just upload the LCR document that we got married and copy of request to expedite the PSA marriage cert, and then upload the PSA Marriage cert when we get it (LCR said should be a month since we will go to PSA office ourself) - will this cause any delay or trigger RFE?  (don't know if anyone will even look at our i130 before we send the PSA cert)

 

Wanting to get clock running asap on i130 and in case the PSA cert takes several months...

Wait for the PSA. You did the right thing by requesting an expedite. The last thing you want is for them to reject the app or give you an RFE, because it's missing and have to start over.

Another vote to wait for the PSA marriage certificate before filing the I-130.  The LCR copy is not enough for US immigration.

Is the PSA marriage certificate the same document I see people in VJ call the CEMAR?

Nope. The Marriage Certificate is just that, a Marriage Certificate. Your fiance will most likely need the CENOMAR to get married. You will both need one before the interview. Hers will change to CEMAR and that is what you will receive also.

 

CENOMAR = Certificate of no marriage (in the Philippines) This is why your fiance will need to get one to get married.

CEMAR = Cerificate of Marriage (in the Philippines). This means that they have record of you being married in the Philippines.

 

Another current post in here is similar to yours. Please read my post in there. It is EXTREMELY important that your fiance go to the Municipal and ask for all requirements for her to marry a foreigner. There are differences in all areas and no real consistency so if you rely on what you see on the internet you may be missing something and not be able to get married. You may also waste time running around to get things that are not even needed.

Boy isn't that the truth! Terribly unorganized in PH and so much waste of time when you cannot depend on anyone's word or published information, so thanks for that!  Do we each need a CEMAR for anything in the process or only the PSA Marriage Certificate?

First thing people need to realize is that not everything is like in America, if you travel a lot, you would more likely see that what it is like in the Philippines is more like the rest of the world. Most Americans are very spoiled in their thinking and expectations. Learn to embrace and accept the differences.

 

As far as the CENOMAR, I think it's pretty consistent across the board for requiring a CENOMAR for a Filipino to get married. They need to prove that they are not currently married first. But the foreigner usually but not always needs an "Affidavit in lieu of legal capacity to marry" to show that they aree not currently married and are able to marry. The need for and how to get an Affidavit in lieu of legal capacity to marry has changed so that is one reason that she must go check exactly what is required.

 

After getting married and receiving the PSA marriage certificate, then you will order a CEMAR from PSA for both you and your wife before the interview. That will prove that you are both legally married in the Philippines, and it is required at the interview.
