I-864 requirements when ex-spouse is earning more than sponsor

Only if below and only if issue is litigated ..( outside of family court). 
Did your spouse pass the I-751 stage ? How close is she to Naturalization under 5 year rule? Is there a way you can incentivize her to Natz?

Sorry for the delay. I wasn't notified of your reply. 

My spouse is actually still on her conditional GC and it will need renewal in Sept 2023. So, not passed I-751. She will 100% not be naturalizing due to China not allowing dual citizenship.

Only you know your soon to be ex…hopefully she goes on her way in life , enjoys working and forgets all about I-864  and you. 
She will need to file I-751 with a divorce waiver..
