Hello, I am also divorce and filed based on 5 years rule. I had my N400 interview on 8/4/2022. The IO just reviewed my answers on the N400 application and the questions I was asked were:

  • What did the Emancipation Proclamation do?
  • What is one right or freedom from the First Amendment?
  • Name your U.S. Representative.
  • In what month do we vote for President?
  • What is one reason colonists came to America?
  • What is the name of the national anthem?

I got all the answers correct. He then handed me a paper that stated I passed the English and Civics test but a decision could not be made due to my pending I-751. My I-751 has since been approved as of December 2022. Still waiting for approval of my N400.

I-751 timeline:

  • 12/04/2018: Mailed I-751 with divorce waiver
  • 12/19/2018: Received by USCIS
  • 5/02/2019: Biometrics appointment
  • 5/03/2019: Case updated to show Fingerprints were taken and applied to my case
  • 1/28/2020: Received an RFE
  • 2/05/2020: Response To Request For Evidence Was Received by USCIS
  • 8/12/2020: Case received at my local office
  • 9/16/2020: Case is Ready to Be Scheduled for An Interview
  • 2/24/2021: Case scheduled for an interview
  • 4/06/2021: Interview done
  • 4/13/2022: Surprise Interview done at  my house
  • 12/08/2022: I-751 with divorce waiver APPROVED!
  • 12/21/2022: 10 yr Green Card Received.

N-400 timeline:

  • 01/26/2022: Applied online and received by USCIS, Informed of Biometrics reuse
  • 06/17/2022: Interview scheduled
  • 08/04/2022: Interview done. Passed English and Civics test but no decision could be made due to my pending I-751
  • 06/08/2023: Oath Ceremony Notice Was Mailed

They can ask about anything in your immigration file.  Be prepared for any question about your past.  Good luck with the interview!

He did not ask anything about my ex… probably because I filed under the 5 year rule. I did come prepared with tons of evidence regarding my previous marriage but there was no mention of it in the interview.

What documents did you bring with you

Marriage certificate, Divorce Decree, Bank Statements, Utility Bills, Tax Returns/Transcripts, Apartment Leases, Dog License showing joint ownership, LOTs of photos, Travel Itineraries, Life Insurance Policy, Signed Affidavits, Copy of my Ex's Driver's License, US Passport and birth certificate. But again, the IO did not ask me to show him anything and did not bring up anything about my previous marriage nor did he ask any personal questions. Just reviewed the application and asked the civics questions.

This gives me hope! I am very nervous about my interview that's coming up in August because my husband filed for divorce in 2019 and the divorce is still ongoing and not finalized yet. I don't know if it will be finalized before the interview or after. I am applying under the 5 year rule because of this divorce and I've been nervous about what they will ask. I uploaded a bunch of documents proving the marriage anyways, such as his birth cert, joint tax records, and health insurance policy. I was advised by a lawyer not to bring up my almost ex. husband unless they do, and to know that under the 5 year rule I am not applying based on marriage, but you never know what the officer thinks and prioritizes so I will bring with me what I can.
