How long should I wait to file for a K1 visa?

I was married once before in the Dominican Republic and brought my ex husband over on a CR1 visa. We had a child together but we divorced last month due to domestic violence that happened last year of 3/2021.

 

During my separation, I reconnected with a old friend from the DR whom I've known almost my entire life and we want to be together. So I am considering a K1 but I think it's too soon to file?

 

Any comments on this?

Have you met the old friend in person in the past two years?

 

There are no hard and fast rules about waiting to file after a divorce, but that timing and the fact that you want to bring another person over from the same country could cause scrutiny.

 

Both of those factors can be overcome with lots of good evidence:  lots of time spent together.

Yes I have visited I march and May of this year and going back next month.

 

 

But I totally get that this can cause some scrutiny

That's good that you have had those visits.  I'd say file now, and maybe by the time of the interview you'll have had another visit or two.  Just document all the visits:  boarding passes, make sure your passport gets stamped if they don't do it automatically, etc.  Good luck!

Seconded, don't wait. Just make sure to front-load your application with proof of genuine relationship. I.e., evidence of time spent together in person.
