Hi all, I have a pending I-130 application for spouse.
Category: USC
PD: 25 March 2022
NOA 1: 9 August 2022
NOA2: Not Received
SC: Vermont
I am trying to gather documents for NVC stage. My question is regarding I – 864. Though I have been a USC I’ve not resided here until 2019. Even then as I was a student with no income, I had not filed taxes. I got job in 2022 so I’m yet to file taxes for this year as well. I don’t have a joint sponsor. What documents can I submit as proof for AOS in this case?

Understand first that tax returns are about the past, so for an employed person, the are not evidence of current income.  You will simply enter the years and zeros and check the box that you were not required to file tax returns.  No need to actually send any evidence of explanation of that.

 

A copy of a current pay stub from your employer is your evidence of current income.  Correct calculation is your gross before deductions for a full pay period times the number of pay periods in a full year going forward from now.  So every two weeks is 26 pay periods, etc.

Facts are cheap...knowing how to use them is precious...
