Hi All, 

 

I want to seek advise before I go to a lawyer for my brother's case. Please feel free to move the thread to the right area.

 

My brother petitioned his wife as K1. Long story short, The wife came over and they got married. While waiting for the change of status, the wife decided to go home without telling the immigration.

My question is, How can my brother bring his wife back to the US? What forms he should file. Is there anyone here with the same situation? Thank you in Advance

To clarify, she left before either Advance parole document or green card was issued?

 

If that’s the case, then the only way forward is filing for a spousal visa from scratch. File I-130 with USCIS, then comes NVC stage then consulate. I don’t see the point of a lawyer, it’s a pretty straightforward case, we’ve seen that happen here plenty of times before.

Thank you for the quick response. Yes, That is correct. The wife left before advance parole or Green Card was issued. Thank you for that. We will go forward with your advice
