Timeline

i am still legally married but separated with my husband when i had my baby with a different father (non-citizen). i gave birth in the philippines. Is there a conflict applying for CBRA?

Your child can get crba and citizenship from you, the U.S. citizen mother, if you meet the requirements.  You must have lived in the U.S at least 5 years, 2 of those after age 14.

Feb. 19th, 2021: I-130 Approved 😊

Feb. 25th, 2021: Welcome letter from NVC

Mar. 9th, 2021:  Received Hard Copy NOA 2 I-797 in mail

October, 2021: One Year Postponement of Move, Visa Completion On Hold

Feb. 4th, 2022: Submitted DS 260

i got my naturalization 2014. Lived in US since then, but going back and fourt in the philippines for vacation. Is the embassy going to ask why i had an a baby to a different father other than my ex-husband (we are not divoreced yet, it is a pain)

I don't see why the embassy would care who the father is, unless there is some sort of custody issue involved. They are not the morality police.

 

In any case, for sure the child is a US citizen through you, the USC mother.
