This is a bit confusing.

One is required to notarize the I-864a but one is not required to notarize the I-864?

Am I understanding this correctly?

Anyone have any experience with the I-864a and having it notarized?

It's not confusing, man. What do the instructions say of the 864? Have you read the instructions of the 864? What does it say?

It's confusing because it's contradictory. One says it's required and the other says it's not. It's contradictory and not consistent. That's why I'm seeking confirmation here.

And yes, I've read all the instructions for both forms. NO where does it state that it's required on the forms itself, only on the USCIS website does it state that the I-864a needs notarization. Again, confusing and contradictory.

If you don't have anything helpful or useful to add, it's best not to comment at all.

From USCIS press office, their fact sheet dated June 21, 2006

http://www.visajourney.com/forums/index.ph...st&p=292751

Q. Does the final rule change the instructions for preparing the Affidavit of Support?

A. Yes. The final rule requires each sponsor to submit as initial evidence only his or her single most recent federal tax return rather than a return from each of the sponsor’s three most recent tax years, pay stub(s) covering the most recent six months, and an employer letter. In addition, it will no longer be necessary to sign an Affidavit of Support, EZ Affidavit of Support, and Contract Between Household Member and Sponsor (Form I-864A) in front of a notary public, immigration officer, or consular officer. Rather, as permitted by Federal law, the forms will provide that they are signed “under penalty of perjury.” Both of these measures lessen the burden on sponsors and household members without reducing the legal standing or enforceability of the documents they sign.

Yet, on USCIS' own website, in the Immigration Forms section next to I-864a:

http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRD

The signatures on the I-864A must be notarized by a notary public or signed before an immigration or consular officer.

Inconsistent and confusing!

With respect, you certainly did not include at the outset of your original query, your confusion between two versions of 864as.

You merely stated your confusion between the required notarization of the 864a and the non-requirement of the 864; two different documents.

So to the contrary, I think I may have helped you here, unknowingly so. Perhaps parsing one's query more accurately can one garner the precise scope of answer which one seeks.

It is quite possible that the USCIS website info hasn't been updated with the information from the fact sheet dated June 2006 so that both places of information are consistent. My suggestion would be to call your local office and ask there.

Neither I-864 or I-864A need to be notarized any more.

After doing more research, I've concluded that the I-864a does not need to be notarized as well. The USCIS website is WRONG and misleading.

Our AoS package was mailed out today and the I-864a was not notarized.

We'll see if we get a RFE, but it's my belief that we will not receive any RFEs with regards to the I-864a and notarization--or lack there of.
