OK, in 2006 I lived in my fiancee homecountry, so my ITR showed below poverty line (and only because my tax guy didn't want to include income from overseas - I hope I won't have to kill him for that). But in 2005 it is all good, and for this year, for last 4-5 months I already made 125% of poverty line. So, would it be a problem that on my 2006 tax returns it is below poverty line?

Also, in 2006 I was contractor only, so I don't have W-2 form, but only 1099-MISC.. is that good enough?

Yes, your 1099 will be good enough. Why did you let your income tax guy exclude foreign income? It should have all been reported. As a US resident for tax purposes you should report all income earned from all sources worldwide. You should have filed 1040 including foreign income and attached a 2555 to exclude up to $82,400 of that foreign income from US taxes. I don't know why your tax guy would not want you to report it. If you made less than 82,400, you don't pay US taxes on it. Also, depending on your work situation, you may have been able to exclude more for the housing allowance.

As long as you made below the exclusion amount, it would not have negatively impacted your tax situation and by your post I am thinking it would have helped get you over the 125% of the poverty line.

You can always file a 1040X to amend your return to include the foreign income. I am not an expert on immigration so I will leave it to others to opiniionate on whether you will need a joint sponsor because of your low reported 2006 income.

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.

Because he is lazy and I was stupid enough to be convinced that I don't need to report it. It was not much, but it would definitely put me over 125% poverty line.

Your current income is the most important. Annualize you current pay as your current income on the I-134 and then support it with pay stubs, an employer letter or whatever you can. If you are still a contractor, that may be difficult but try. You'll need supporting documentation showing sufficient current income.

My current income is good and I am not contractor now. That should be enough? I have employer letter and pay stubs for the past 4-5 months.
