Hi,

 

I have a pending I-485 for more than 6 months and was informed that my employer will be laying me off by July.

 

I am currently on H1B and have received my EAD and AP.

 

I expect my priority date to be current with next Visa bulletin. (EB2 - Jan 2011 - India)

 

I am looking for new jobs but wanted to understand what are my options incase I get called for GC interview ?

 

1) I can have a prospective employer provide I-485J and indicating that they are willing to hire me once I receive my Green card. Is this sufficient ?

 

2) Do I need to get paystubs, W2 from this prospective employer to show interview officer ?

 

Any help is appreciated.

1. I485j isn't provided by the employer, you'll fill it yourself and send to uscis. You need to include the items from 2 below. You may want to file it asap as soon as you have the new job offer. 

2. No, all you need is a job offer that mentions the responsibilities and salary which has to be similar to what was mentioned in the i140.

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

What happens if I am unemployed after my current job ends ?

 

I do have a prospective employer who is ready to hire me once my green card is approved and willing to support my I-485J.

 

I do have an approved EAD card and I am on H1B and planning to move to H4 to save my H status (backup) 

 

Is there a cause of concern if I am not on active employment while waiting for my green card to be approved ?
