No and yes. The USCIS processes I-129F petitions that can result in a US Consulate (part of the Department of State) issuing a K1 visa.

If you already have a K-1 visa, under which you got married, why does it matter?

Either way, the Embassy/Consulate issues visa's, not the USCIS. The USCIS role is to do the initial validation of the relationship, whereas upon approval, your case is forwarded to the applicable Embassy/Consulate for visa issuance, surmising the interview is successful.

USCIS basically says you are allowed to go apply for the visa. Where on earth did you hear that there were no more K1's???

AOS

Mailed AOS, EAD and AP Sept 11 '07

Recieved NOA1's for all Sept 23 or 24 '07

Bio appt. Oct. 24 '07

EAD/AP approved Nov 26 '07

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08

No and yes. The USCIS processes I-129F petitions that can result in a US Consulate (part of the Department of State) issuing a K1 visa.

USCIS has never been the division/department/entity that issues K1 visas.

USCIS processes I-129F petitions -- as long as the petitioner proves they are a US citizen and that the two people have met in the prior two years, petitions are approved. An approved petition is an approval for the foreign fiance to have an interview for a K1 visa - nothing more.

US Consulates/Embassies interview and make the decision on issuing K1 visas. An approved petition does not equal an approved K1 visa.

So no, nothing has changed. USCIS never "did" K1 visas - they only processed petitions which they still do.
