Hi all!

 

I was wondering if someone could help clarify some things when it comes to filing their I-130 IR1/CR1 as a DCF (exceptional circumstances)?

 

I am a US Citizen and I reside with my wife (Czech Citizen) in Prague, CZ. We have been living together here for about 6 years and have been married nearly as long.

 

We will most likely be moving to the US at the beginning of next year, as I know my work wants to relocate me to the US around that time, but an official date is to be determined.

As far as I understand, once I would have an official start date in the US from my company, we can file I-130 IR1/CR1 as a DCF (exceptional circumstances) under the stipulation - Short notice of position relocation.

Also I believe we would have to do this via Frankfurt, as I don't think Prague deals with this unfortunately.

 

Can someone please confirm if this is correct, or correct me if I am misunderstanding something?

You can not simply file at the consulate,  your circumstances must be approved prior to a filing being accepted.   Prague is the place to start as Frankfurt does not have jurisdiction.

I should have been more clear in the initial post, the timeline for something like this should be :

 

- Submit request to file DCF with US embassy in Prague, CZ

- Hopefully receive a response to come fill in the I-130

- I believe I-130 would then be transferred to Frankfurt for processing

 

Would that be about right?

No.  If the DCF request is approved by the US embassy in Prague, then the entire process will be through that embassy.  The case will not be transferred to Frankfurt.  If your wife has citizenship and residence only in the Czech Republic, then only Prague would have jurisdiction over her visa process.
