Hi i am dating a USC and we have decided that we want to be together.Iam from the uk , hes unable to move there due to being unable to take his children out of the Us , he has joint custordy.So we decided best way is for me to move out there with my children

Aew we better getting married in uk then me applying for visia or better to apply for a fianccee visia and me and the children go out on that , can i take the kids out on this visia.We both want to be together but want to do it the correct way even if this tkes time. so any help would be greatly appreciated

im definitely not an expert on this topic, but im almost 100% sure you can do either of them...check out the guides on this website and see which one you think is a better fit...i do know that you can file to bring children with the k1 as well as the k3

3 Options

1) Mary in UK and file for K-3 or CR-1

2) File for K-1 and Marry in the US

3) Visit US Marry then return to UK and file for K-3 or CR-1

The children will receive derivative status and be allowed to follow to join the fiance(e) (ie.. K-1 visa) with a K-2 visa, if a spouse (ie.. K-3 visa) the children will receive a K-4 visa.
