Hi we are filing our joint tax return for the first time since marrying in December. We know we have to file W7 and get an ITIN etc but we have a question about the tax return itself.

Do we need to enter the foreign spouses income in the same tax return being sent to IRS with form W7

if yes (which I believe the answer) do we enter income just in 2020 calendar year and how would we attach W2 as U.K. citizens do not get W2

uk citizens get a Tax Year to date P60 slip on April 5 for everything earned from April 6 - April 5 as that is the tax year in England.

So how would we attach a document if they do not provide such in the U.K.  Has anyone else had this issue and how do you get around it? Do we just add up the U.K. citizens income for the year and add it without any slip or form of proof?

Further to my post, how do we also claim the tax treaty benefit since the spouse is from the UK, is there a form to fill out or anything similar.

No form to fill out specific to a treaty.

Also no W2 or P60 to attach. Just report what was earned between Jan 1 and Dec 31, 2020 converted to USD $$$$. They take your word. No documentation is sent.

Are you using software?

  • Yes we are usuing TurboTax. To add foreign earned income we have to pay extra. We were planning to use turbotax to fill all the forms out so we can print off and then attach W7 and 2555 and send off.
