Hi everyone,

 

I hope you all are well and safe.

 

I am currently in the process of becoming naturalized (3 years of PR comes in June 2021), and wanted to plan ahead. My mother, who resides here in the United States, was in the process of becoming a permanent resident when it was denied. Her and my dad sunk a lot of money and did not have enough to recoup the losses and did not try again. Since then, my dad has gone back to the Philippines and my mom has stayed here. She was processed legally when she entered the United States (back in 2002) as she had a visa, and has kept up her passport valid with the Philippine embassy. When I petition for her once I become a naturalized citizen, will she have to go back to the Philippines? Anyone have similar experiences that they can share with me?

Sounds like has a complicated immigration history.

 

So all I can say is having been inspected on entry and having overstayed she can adjust in country when being petitioned as an immediate relative.

 

What impact the other stuff would have of course not a clue.
