Hi

Your K3 application in process might show up, but it is still up to the customs agent if he /she lets you across the border. It is not illegal to cross the border if you have a visa or if you are a canadian citizen(you don't need a visa to cross to the USA).

I always crossed the border in Ontario and nothing ever came up when they scanned my passport however, they always asked the same old questions

"where are you going?"

"who are you staying with?"

"what is your relationship to this person"

"have you started any immigration paperwork? Do you have proof of that?"

I always answered honestly and never had a problem crossing over.

they very likely asked you "have you started any immigration paperwork" because they *did* have it come up on your passport scan, and wanted to see whether or not you'd lie about it. They're sneaky that way ;)

I always wondered that. With my monthly trips to DC while the visa process was ongoing the POE officer never mentioned anything! WIth most of the USA police world not all connected,it wouldnt suprise me if immigration wasnt fully compatible!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied, that is if ur polite and didn't lie! Refer to #1

Zyg...is the correct term "customs and border patrol" or "customs and border protection"?

We are working on updating the FAQ....

I am not 'Zyg...(?)' but as far as I know it is Customs and Border Protection. Their stamp on passports... and here is their website : http://www.cbp.gov/

:innocent:

I am now a US citizen.

as the OP i appreciate when people take time to answer but get frustrated when the answeres are off topic or not clear.

for example, reba says "they very likely asked you "have you started any immigration paperwork" because they *did* have it come up on your passport scan, and wanted to see whether or not you'd lie about it. They're sneaky that way "

has this actually happened to her? or is she just making stuff up? i never said that they asked me any questions related to a visa application.

and then ziggy says "we are (sneaky). is he a POE officer? how am i supposed to know this. there is an ex CBP officer who shows a pic of him in his uniform so it is pretty clear.

and finally, people should make their topic subject titles clear.

"help" is less descriptive than "i have a question on my I-xxxform"

many of us are busy, would love to help if we have some knowledge but don't want to read every post out here.

again i would like to say thank you to those who respond with pertinent information.

aloha

Yes...the files from the USCIS overlay into the cbp data bases. I dont know, but it may be slow in coming when you present your passport coming to the US from Canada, but if you are flying from overseas, the airlines submit their passenger lists to ICE at takeoff. They have several hours to run all the names, and they know who they want to talk to when you arrive at the US POE.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

my response was to the post directly above mine, and *that* person was asked about her immigration status, and does have a direct relation to this topic and question of yours. And yes, CBP officers are sneaky and will not directly say "hey, I see you have an application for a K3 in here, how's that goin'" :P

Yes, the immigration application is linked to the computers at the borders, and when they scan your passport they will see an active application has been submitted with your name on it. They will ask you the purpose of your visit, and if any of your answers conflict with the information they have on screen, you could very well be denied entry.

So sorry for confusing you.
