Hello Everyone,

 

I sent in my application to remove conditions on a temporary green card on Oct. 28. It was received on Nov. 2 and today Dec. 10 I received my I-797 Notice of Action form.

It did not include anything specific to my case other than it is being processed.

 

Here is my question: Has anyone received a RFE at a later time after they got their I-797? Would USCIS normally send that request alongside my I-797? My petition was based on a waiver; ex-spouse and I were divorced at the time of submitting my petition so a final divorce decree was included; ex-spouse is supportive of me and offered me an affidavit which was included.

They just received your I-751. The I-797 is your extension letter.  That is all.  No one has looked at the file yet, so, yes, RFEs can still be issued......Some of us have been waiting since MARCH 2019.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

There are various types of I-797. Did you get a I-797 or I-797C?

 

It kinda seems like you got a I-797C to tell you that USCIS received your ROC package and it is being processed.

 

I-797 is usually to tell you if you are approved.

 

If you got a I-797C, RFE would come after this, if any and before a I-797 for sure.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

The form just says I-797. Under "Notice Type" it says "Receipt Notice".

Is it your extension letter, stating that it extends the expiration date on your card by 18 months?
