I just got confused about K1 visa petition in China. According to USCIS website, K1 is a NON-IMMIGRANT visa.

The website of us consulate in Beijing states that it does not process IMMIGRANT visa, yet it put K1 and other fiance-type visa together with the IMMIGRANT visa.

The website of us consulate in Guangzhou even categorizes K1 as an IMMIGRANT visa, which contradicts what USCIS says.

So where should my fiance go to get her K1 visa? She lives Beijing, so we put BEIJING on form 129F as the consulate that would process her case. But now, it seems Guangdong is the only place for K1...

Can someone give me a definitive answer? All the information out there is just confusing as hell. thanks

The K1 is a "non-immigrant visa" but because it is classed as a "non-immigrant visa w/ an immigrant intent" (i.e. the beneficiary comes here to marry and intends to stay and establish life here and adjust status later) the consulates process these visas in their Immigrant Visa sections. This is to say that the process is more detailed that that for a tourist (or other non-immigrant) visa.

The K1 is a "non-immigrant visa" but because it is classed as a "non-immigrant visa w/ an immigrant intent" (i.e. the beneficiary comes here to marry and intends to stay and establish life here and adjust status later) the consulates process these visas in their Immigrant Visa sections. This is to say that the process is more detailed that that for a tourist (or other non-immigrant) visa.

A few things, K-1 is a non-immigrant visa with immigrant intent, so the immigrant visa unit at the consulate in the foreign country handles them like immigrant visas, the exceptions are that they use DS-156, and I-134.

In China the only consulate that has an IV unit is Guangzhou so there is where the K-1, K-3, CR-1, and IR-1 visas are handled and interviews are held.

You must indicate Guangzhou on the I-129F.

Lastly,

Since you are starting out, I HIGHLY recommend that you visit and Join "A Candle for Love" that site covers all the pitfalls, and immigrations process through that consulate, as well as many other things involving American/Chinese relationship wise, customs, ect.. Their FAQ section is the most complete on the web, covering everything from start to end, interview questions, There is even a person employed at the consulate that regularly answers questions on that site.

We filled in Beijing and just got NOA2. Anyone know what will happen? Will the USA automatically send to Guangzhou, or must it go to Beijing then to Guangzhou? My fiance is in Beijing.

Will she have to go to Guangzhou to schedule the interview and for the interview itself?
