Hi everyone, im on F2B and I already received an email from NVC last March that my documents have been "Documentarily Qualified". I was told to wait for an update for my medical exam and interview appointment. 

 

Then, i just recently found out about this immigration ban which answers my question why i still havent received an update from NVC. Im glad i came across this forum and learned new information about the immigration process. But, i still have a few questions in mind:

 

  1. My NBI Clearance was already accepted by NVC through CEAC but it doesnt have an "AKA" on it. Do they really require you to put an alias even if you dont have one? Im thinking if i should request for a new one with AKA since the old one that I submitted will expire in December anyway.
  2. I also read something about the new public charge rule. I read somewhere that the US Embassy will or may ask you to fill out a new form DS 5540 prior to your interview. Does anyone here who were interviewed recently filled out that form?

1.   No  to an AKA, unless you have used OTHER names.

 

Please note that an NBI Clearance with an AKA is also required. Police clearances should be in the applicant’s current name, birth certificate name, maiden name, married name, and any aliases or nicknames ever used, including different spellings of all names that may have appeared on other civil documents (e.g., birth certificate, marriage certificate, etc.), even if these names or spellings have never been routinely used

Update on Public Charge

Last Updated: August 7, 2020

 On Wednesday, July 29, the United States District Court for the Southern District of New York enjoined the Department of State from “enforcing, applying, implementing, or treating as effective” the Department’s October 2019 interim final rule and accompanying Foreign Affairs Manual guidance related to the public charge ground of visa ineligibility.  The Department is complying with the court’s order and is in the process of updating its guidance to consular officers on how to proceed under the preliminary injunction. In the interim, visa applications that appear to be ineligible under INA 212(a)(4) will be refused for administrative processing to allow for consultation with the Department, including legal review to ensure compliance with applicable court orders.  Visa applicants are not requested to take any additional steps at this time and should attend their visa interviews as scheduled.  Applicants are not required to complete nor should they present the DS-5540, Public Charge Questionnaire.

Check again at the time of visa interview. Depending on what the courts decide, the DS-5540 requirement may or may not come back.
