Hi,

 

We've received the NOA2 letter, but it's been 71 days and we still haven't received the letter that confirms that the NVC has forwarded the petition to the Brazilian embassy. And on October 29th, the I-129F will expire, and we are reluctant to inquire the NVC about this issue because their contact page says that "you should only contact us in case of medical or humanitarian emergency due to reduced staff." And we don't know if we should contact the embassy either because we assume they don't have the petition yet.

 

What should we do to we ensure that the I-129F isn't going expire?

You don't need to do anything.  If it expires, it will be renewed by the embassy.

 

You're right - if you contact them while it is still at NVC, they won't be able to do anything.

Using the case number you can check your current status at CEAC.state.gov, enter "immigrant" as your visa type and your case number.

A fiancé visa must be issued within four months from the date of approval of the fiancé petition by USCIS (U.S. Citizenship and Immigration Services). If your appointment is later then the validity date, bring a signed and dated letter from your U.S. fiancé(e) stating that you both remain legally free to marry and that you intend to get married within 90 days of your arrival. E-mail or copies are acceptable.

 

9 FAM 41.81 N6.2 Validity of a K-1 Petition
(CT:VISA-2165; 08-21-2014)

 

An approved K-1 visa petition is valid for a period of four months from the date of USCIS action and may be revalidated by the consular officer any number of times for additional periods of four months from the date of revalidation, provided the officer concludes that the petitioner and the beneficiary remain legally free to marry and continue to intend to marry each other within 90 days after the beneficiary's admission into the United States.

Contacting the embassy at this stage is fruitless. They don't have any information about your visa so you would be wasting your time as well as the time of the agent that is answering your call.
