Hi,

I recently quit my job to start a tech start-up (sole proprietorship) business.

 

By July of 2020, my 2020 annual income for 1 person income should be around 4 times more than the income threshold required to submit an I-864 for my wife and 2 kids, which I intend to submit in/around March of 2020. 

 

I've registered my (sole proprietorship) business with my state and got an FEIN # from the IRS. I do not anticipate any income from the tech start-up business by the time I submit I-864.

 

My question is like this: Do I have to have a current employment/income/pay stubs to file I-864? If you need more clarification of my situation, pls let me know

I assume you mean March 2021 is when you will submit the docs.
 

Are you saying you won’t have an income by the time you submit the I184? If so, then you must find a joint sponsor that makes enough to cover your wife and 2 kids. You must have income To be the only sponsor.

I'm filing I-864 by March 2021 (sorry for the typo).

Yes, I will not have any current income by then, but for the 2020 tax year, I should have over 50K income for myself from my job that I quit this month.

I'm aware of joint sponsorship for filing IF I don't have enough income, but I will have that, AND, as I mentioned, I might NOT have any current income/pay stubs until then at that time

Your opinion?

Unfortunately what you make this year doesn’t matter. They want to see current income at time of submitting the form. For ex even if you had already made 50k as of Feb 2021 but you lost your job-even a week before submitting I-184 you’re current income would be $0 and you would need a joint sponsor. So as of March 2021 if you don’t have current income/pay stubs you will need a joint sponsor. Hope this is clear.
