Timeline

Do I have to stay in the US after getting married if my future husband needs to PCS overseas? 

Dated for almost 3 years before he proposed. 💍

16 Oct 2019 - Sent I-129F

18 Oct 2019 - Delivered

24 Oct 2019 - NOA1 notice date

7 Feb 2020 - NOA2 notice date

13 Mar 2020 - P3 Received

20 Mar 2020- DS-160 fee paid

15 Jan 2021 - Visa Approved!

21 Jan 2021 - Visa status changed to "issued"

27 March 2021 - Entered US

21 April 2021 - Married 👰🤵

30 April 2021- AOS delivered

If he is PCSing overseas and you are on his/her orders, you don’t have to stay in the US, you can  go with your spouse and get your green card overseas. If you decide not to travel with your him/her, you can submit I131 alongside your AOS application. This allows you to temporarily travel outside the US while your case in pending However, you should be able to attend your biometric appointment and your spouse needs to be present for an interview. If he/she is on deployment and not a PCS, you alone can attend the interview with your spouse’s deployment orders and of course you have to be in the US for that too.

Thank you for your response! He would need to make a decision as soon as possible. I will only be able to be included in his orders only if we are married already am I right? We are afraid that he might PCS before we got married because of corona 😔

Yes that’s correct, you’ll only be in his orders if you’re married and he adds you as his wife the military database (DEERS) and you get a military dependent ID. Are you in the US already?

No unfortunately :( because of the Corona my Visa process is currently put on hold. US embassy in indonesia is not conducting interviews at the moment. 

Do you think that he will be able to go back to the US to get married while PCSing ? Will he be able to add me to his order after marriage?

I understand how you must feel but unfortunately, he can only add you to his orders before PCSing (after marriage of course). Do you know where he is going? That’ll determine if it’s a PCS or deployment. If it’s a PCS, yes he can take leave and come to the US to get married. But if it’s a deployment, unfortunately he can’t unless there is an emergency and a Red Cross message is sent.

He wants to PCS to Germany but because of this he might not. He could bring me to Germany after we got married but we would have to bare the costs of getting me there. And I would have to stay in the US for probably a year until I get my green card before I am able to leave the states.

Your fiancé should probably talk to his leadership if they can delay his report date or even extend his stay in his current unit (that is allowed due to COVID). At least it’ll give you time to get to the US and get married, take care of the paperwork and add you to his orders so you guys can go together. But you still haven’t attended your K1 interview right? Get your visa first and you guys can figure it out. I believe with your visa in hand, it’ll be easy to make a decision to extend his stay in his current unit. You don’t want to violate your K1 visa by not getting married.

He wants or he already have his hard orders? PCS season put on delay because of red zone everywhere and DoD lifted up the restriction not so long ago. U gotta check with his branch,also did he get his ETP yet?

He wanted to. But unfortunately, he has been selected to go to DSS. 😕

DSS west point academy or Defense Security Services? If west point then he should take that oppurtunity,soldiers can marry with proxy if they deploy. PCS also but u gotta see area and rules also rank because not all places can bring spouse/family.

Oh drill sergeant,well cant guess base for sure even when u have hard order in hand and already sit on plane ready to fly for next base they still can change it. Nothing in military that u can be sure enough 😅
