Dear all, 

 

This is a great forum, thanks a lot for sharing your comments on the different cases - very insightful. I am hoping to get some help on my situation:

 

  • I am a French citizen and entered the US on a J1 intern visa in September 2019 (the J1 expires end of July 2020 and I am not subject to the 2 year home residency)
  • After 5 months in the US, I married my wife who is French and has a green card
  • I then filed for a green card end of February 2020 - I am still working at the J1 company until the contract expires 
  • I was supposed to do the biometrics meeting in March but covid put everything on hold
  • In the meantime, I was admitted to graduate school in the US with a start in September 2020

 

Question:

 

  • Given the situation, it is unlikely that my EAD will be delivered before September 2020 – can I attend my graduate program without it?

It’s up to the school policy you are attending to. If your school has accepted you based on your pending i-485, you can start attending the school. EAD once in hand allows you to work, has nothing to do with the study.

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

2017-03-02: Oath Ceremony
