Affidavit of Support

Hello,

I am a US Citizen and I am sponsoring my spouse who is a Lebanese citizen currently living in Lebanon.

I just received a "Notice of Immigrant Visa Case Creation" from the National Visa Center(NVC) with a case number and an Invoice ID Number. I went ahead and already paid both fees :

1) For the Affidavit of Support

2)For the IV Application.

I recently started working and last year I did not file taxes as I was a full time student. I did work through the month of December 2019 and filed this years taxes about a month ago.(Married Filing Separately) . The income listed on my W2 is only for the month of December so my Year to Date is below the poverty line. However, my projected income based on the contract with the firm I am currently employed full time at is well above poverty line.

1) So my question is will I require a joint sponsor for my wife's application? If so do I need to have the submit their I-864 from the get-go when I submit my separate I-864 ?

2) Is there a way to use Projected Income to act as proof for the Affidavit of Support ?

3) Which form is more applicable to fill out the I-864 or the I-864EZ

Thank you,

Gerrard

Unless, your spouse is going through Mumbai, you are probably going to be ok with your current income.  What you are calling your "projected income" actually IS your current income.  Current income is the biggest factor in qualifying.  Calculate your current income by using the gross income figure from a pay stub representing a full pay period.  Multiply that number by the number of pay periods in a full 12 months.  That's your "current income".  For example, if paid every two weeks, then times 26, weekly 52, twice a month, 24.  Details matter.

If it's Mumbai, get a joint sponsor that has qualifying income now AND for the last three years.

You can use the EZ version of the form.

Thank You pushbrk

We are not going through Mumbai as she is currently in Lebanon not India. So we are going through Beirut.

Just a quick follow up.

So even though my 2019 income is below the poverty line, ( since I only started working in December of 2019), I will not need a Joint Sponsor as my current income is above the 125% of the poverty line.

How do I prove to the NVC that my current income or projected income will suffice to sponsor my spouse without providing Tax evidence?

Thanks

Include a pay stub.  That's your evidence of current income.  They can do the same math I suggested you do.

The Consular Officer will make a judgment call.  If you just finished college and started your career with a good income, chances are you will be fine.  No guarantees on judgment calls.
