Hi all,

I have a few concerns as to the proper way to answer certain questions on the I-130 form as used for the K-3 visa.

Q21. If filing for your husband/wife, give last address at which you lived together.

As we were just married last week, we have never lived together. She lives in Colombia with her parents and I live in the US. What should I put here? "N/A" or should I write a line explaining the situation?

Q22. Complete the information below if your relative is in the United States and will apply for adjustment of status.

I had simply left the whole thing blank since my wife has never been outside of Colombia. However, in the example I-130 (for K-3), the second part <i>If your relative is not eligible for adjustment of status, he or she will apply for a visa abroad at the American consular post in:</i> is filled out. Should I leave this blank as I originally planned or should I put "Bogota, Colombia"?

7/27/2007 - Sent I-130 Package to TSC*

7/30/2007 - Received by TSC

8/28/2007 - NOA-1 date - CSC

3/19/2008 - NOA2 date -CSC

I-130 held by USCIS for future AOS

I-129F

7/27/2007 - Sent I-129F Package to TSC*

7/30/2007 - Received by TSC

8/30/2007 - NOA-1 - Fee waived

3/19/2008 - NOA2

4/3/2008 - Received by NVC

4/10/2008 - Received by embassy

4/11/2008 - Faxed packet 3 forms to embassy

4/30/2008 - Appointment date assigned

6/19/2008 - Appointment at Bogota Embassy - APPROVED!!!

No touches except when I called CSC directly to inquire.

8/28/2008 - POE Houston

Still being lazy and waiting to do AOS.

*I-130 and I-129F sent together to TSC per USCIS instructions.

21 Dont use N/A, because the question does apply, just you did not live together so write "NONE"

ONLY USE N/A FOR THINGS THAT TRULY DO NOT APPLY TO YOUR SITUATION.

22 Your original idea is correct "will apply for visa abroad... Bogota Columbia.

Second. Question one is applicable. The answer is "none". Answer to question two is Bogota, Columbia.

Q 21: You can simple write as Yodrak suggested "We have not lived together" or you can write "N/A," but I prefer the former.

Q 22: Write "N/A" on the first part and in the 2nd part, you should write "Bogota, Colombia."

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Question 22. I put Bogotá, Colombia.

11/16/07 - Received green card and Welcome to America letter in the mail

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

CSC approved it with no problems.

From my experience with VJ members, I have found out that any reasonable answer of question 21 is acceptable by USCIS. Some did mention "N/A," Yodrak simply wrote "We have not lived together" whereas some did mention a address where they spent few days together after marriage. I never heard of any problem for those answers.

For that question, I simply put: "We have never lived together. Married 5/18/07" I suggest that you do not make this any more difficult than it is...keep it simple and honest.

I typed in None, and then Bogota, Colombia for the next question.

This more specific answer that Craig suggests sounds better to me.
