I've read a couple different things about this so far from searching the forums...

I get divorced on July 17th, officially.

I was planning on dropping the petition to USCIS within a day or two after that. My divorce decree states that my wife and I have not "lived together or cohabitated" since October 1st, 2005. However, we will not be officially DIVORCED until July 17th.

My K1 petition for a fiance living in Thailand.

Is this going to draw up any fraud flags on my petition? Will they think this divorce is being done to get someone from a third world country into the US?

Is there anything extra I should include with my petition to help quiet any suspicion of fraud and move my petition forward for approval?

and finally...one more question...on my last trip to Thailand, I was stopped in customs and a State Department officer asked me about my trip. I told him it went to go see my girlfriend and that I was hoping to move her over to the US someday soon. At first, i said I'd get her a tourist visa, then marry her here if it all worked out. Then he informed me that was illegal and I would need a Fiance Visa. That was the end of the interaction mostly, but he seemed really shady. Is there anyway those guys can pull you up in there computers and make notes about you or anything? Might sound like a stupid question, but it's got me worried.

11 JAN 08: Interview...approved already before getting to the window!...NO questions asked

25 JAN 08: My lady arrives in IAD-Washington DC:)

19 APR 08: Married in Alexandria, VA (5 days before Visa expires)

20 JUN 08: Mailing in AOS packet

18 DEC 09: GREEN CARD RECEIVED:)

The only thing thats really diffrent is that you need to include a copy of the divorce decree with your filing. There will be some qestions on the I-129F that you will answer diffrently.

You may also need to send a copy of the divorce decree to your fiancee to be taken to the interview.

I got divorced on 12/19/06 and re-married on 01/25/07 and everything went okay for me.

Oh and another thing, even if they could make notes on you it would not be uncommon for you to be visiting your "girlfriend" and not be educated with the laws of immigration. As long as you can prove the validity of your relationship with visits, letters and all that, then it should be ok. Obviously you are not doing it illegally so it would hold no realy baring to your actual case. All it does is prove that you were going to see her and that can't be seen as bad despite what you say at customs. Your action to petition for her shows that you indend on doing it legally.

Quite... even if such a mechanism did/does exist, so what? You had an idea of how you might go about things in the future, which you since found out (when informed by the immigration officer) wasn't the way to go about it - he advised you as to a better (and legal) way to achieve your goal. All of which is perfectly fine - he told you you should apply for a K-1, and... that's what you're doing! If it should happen to be on file that you'd been told in no uncertain terms by an immigration officer that it'd be illegal to bring your fiancee to the US on a tourist visa with the intention of marrying her and having her stay for good, and then you went ahead and did just that anyway... that would be something to worry about. But being given advice by an immigration officer and then acting on it? What's to worry about there?? :)

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

As mentioned before, the divorce decree. Be prepared for your Fiance to validate your relationship. This is usual and customary, but prepare her well.

They do not have the resources or interest to track this level of detail. Too busy worrying about terrorism.

My situation was similar. I got divorced last year on Sept 26th and remarried to a Thai national on Oct 9th. The only thing I would advise is to make sure you have a "certified" copy of the divorce decree and not just the one your attorney has prepared. The dates can be different. My court date was September 25th, but the divorce was not entered into court/county records until the next day. My attorney had advised that I not doing anything (re-marry, buy/sell real estate, etc) until it had been officially recorded. He added that it can sometimes take up to 30 days. Probably not a real issue since you are filing the 129f as it requires a certified copy of your divorce decree proving the previous marriage has been terminated.

I filed the K-1 for Claudeth the day after my divorce was final. You will need a certified copy of the divorce final from the court. Good luck :thumbs:

The 17th is my birthday so that should be a really good day for both of us :yes::P
