Applying for citizenship with a prior arrest from many years ago.

Hey There,

 

I have been a permanent resident in the USA for 12 years now, and FINALLY working on filling for my n400. However as a minor I was cautioned for shoplifting, and never went to court just a warning (on my police record )  I disclosed this during my application for spouse visa, and was approved. Apparently, it was not enough to disqualify me. Now, I'm filling out my n400 form, and it is asking if I have been charged, and the next question convicted? Do I say yes, to be on the safe side? I have no documents regarding and of my warning which the police actually called reprimanded....and I gave anything I had back to the immigration officer at my interview 12 something years ago. Will they still have that on file somewhere?

 

Has anyone gone through this? I'm from the UK if that makes a difference?

I'd say do a quick consultation with an attorney to be on the safe side and to know how to properly disclose it. However, I'd say yes definitely disclose it. 

 

In my case I had a traffic ticket that was dismissed by the court. On the application I selected that I was cited and the ticket was dismissed, and I attached the ticket and the document from the court saying it was dismissed. Then I attached a letter explaining what happened and how I have never been pulled over in my life. 

 

Always disclose everything. You don't want anything delaying your case or making them raise some eyebrows.

If the shoplifting happened in the UK when you were a minor, I would not bother mentioning it in the N-400. USCIS will generally look at anything you did while in the US prior to your Citizenship application and interview. If you kept a clean slate these past 12 years while being in the US then you should be fine. I wouldn't even bother to talk to a lawyer if I were you.

Hello, 

 

I am k1 visa holder. I got divorced than I remove the condition. Now I have 10 years Green Card. It is time to apply for N400 citzenship. BUT I had a big fight with my x wife few years ago. I kick her out of the house. He dad call the cops and the cop came to my house accusing me with insulting and threatening her. 

 

The cops just told me that they are just going too talk to me. They came inside the house. Asked me if I hit her ore anything which I did not. 

The cops made sure that we know the law if she hit me or I hit her. One of us will go to Jail. Then they left 

They did not take my ID. They did not do anything.

Is that arrest or charge or anything?

Should I mention it in the application?

What should I mention?

I never have any thing else rather than that story.

Please help me

You are not a K1 Visa holder.  You K1 was used once and then no longer exists.   You are a LPR.
